1. Acceptance of Terms

By accessing or using VPATify, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you must not use the service.

2. Description of Service

VPATify provides automated accessibility scanning, VPAT document generation, and a marketplace connecting organizations with accessibility specialists. The platform helps organizations evaluate their digital products against WCAG 2.2 criteria and produce Accessibility Conformance Reports.

3. Accounts

  • You must provide accurate, complete, and current information when creating an account.
  • You are responsible for maintaining the confidentiality and security of your account credentials.
  • Accounts are for individual use only. Each person must have their own account. Accounts are non-transferable.
  • We reserve the right to suspend or terminate accounts that violate these terms.

4. Free and Paid Plans

  • Free tier: single-page quick scans are available without creating an account.
  • Paid plans: multi-page Deep Scan, VPAT generation, team collaboration, and compliance dashboards are available on paid tiers.
  • Current prices are listed on our pricing page. Prices are subject to change with 30 days written notice.
  • All paid plans include a 14-day money-back guarantee.
  • Billing is processed through Stripe. Subscriptions are recurring and will renew automatically until cancelled.

5. Acceptable Use

When using VPATify, you agree not to:

  • Scan websites you do not own or do not have explicit authorization to test.
  • Attempt to circumvent rate limits, scan quotas, or other usage restrictions.
  • Use the service for any unlawful purpose.
  • Interfere with or disrupt the service, servers, or networks connected to the service.

6. Intellectual Property

  • You retain full ownership of your scan results and any VPAT documents generated through the platform.
  • VPATify retains ownership of the platform, its tools, algorithms, designs, and all associated intellectual property.
  • WCAG criteria descriptions referenced within the platform are derived from W3C public specifications and are used under the W3C Document License.

7. Marketplace Terms

  • VPATify operates a marketplace that connects organizations with independent accessibility specialists.
  • Specialists listed on the marketplace are independent contractors, not employees or agents of VPATify.
  • VPATify does not guarantee the quality, accuracy, or timeliness of work performed by marketplace specialists.
  • Disputes between clients and specialists are to be resolved directly between the parties involved.

8. Limitation of Liability

  • VPATify provides automated scanning tools and document generation. The platform does not provide legal advice.
  • Scan results do not guarantee full WCAG conformance of your digital products.
  • Automated accessibility testing tools typically detect approximately 30-40% of accessibility issues. Many criteria require human judgement.
  • We strongly recommend manual testing by qualified professionals in addition to automated scanning.
  • VPATify shall not be held liable for compliance decisions, procurement outcomes, or legal actions based on scan results or generated documents.

9. Disclaimer of Warranties

The service is provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. VPATify does not warrant that the service will be uninterrupted, error-free, or free of harmful components.

10. Termination

Either party may terminate the service relationship at any time. Upon termination, your data will remain available for export for 30 days. After this period, your data may be permanently deleted from our systems.

11. Governing Law

These terms shall be governed by and construed in accordance with applicable law. Any disputes arising from these terms or your use of the service will first be addressed through good-faith negotiation between the parties before pursuing formal resolution.

12. Changes to Terms

We reserve the right to modify these terms at any time. Material changes will be communicated with at least 30 days notice via email or a notification on the platform. Continued use of the service after changes take effect constitutes acceptance of the revised terms.
