AODA Web Accessibility Guide

Ontario's Accessibility for Ontarians with Disabilities Act requires organizations with 50+ employees to meet WCAG 2.0 AA for websites and web content. Compliance deadlines have passed for most organizations.

Overview

The Accessibility for Ontarians with Disabilities Act (AODA) is Ontario, Canada's comprehensive accessibility legislation, enacted in 2005 with the goal of making Ontario fully accessible by 2025. The AODA's Integrated Accessibility Standards Regulation (IASR) includes specific requirements for websites and web content under the Information and Communications standards.

For web accessibility, the AODA requires websites and web content to conform to WCAG 2.0 Level AA. Compliance deadlines are staggered by organization size: large designated public sector organizations (50+ employees) and large private sector organizations (50+ employees) were required to comply by January 1, 2021 for new and significantly refreshed content. Existing web content (before January 1, 2012) is exempt from WCAG compliance unless it has been significantly refreshed.

Non-compliance with the AODA can result in administrative monetary penalties of up to $50,000 per day for corporations, and up to $100,000 per day for corporations in severe or repeated violations. Ontario's Accessibility Directorate monitors and enforces compliance through annual compliance reports filed by organizations with 20 or more employees. Despite the deadlines passing, many Ontario organizations remain out of compliance and face increasing enforcement scrutiny.

Who Must Comply

Organizations with 20 or more employees operating in Ontario are subject to AODA requirements. Web accessibility (WCAG 2.0 AA) is specifically required for organizations with 50 or more employees. This includes private sector businesses, public sector organizations, and non-profits with sufficient employees. Organizations with fewer than 20 employees have simplified requirements.
